Summary

This bill prohibits the Secretary of Transportation from using, procuring, or contracting for LiDAR technology from certain foreign entities, and from awarding grants or loans for such technology, with limited exceptions.

Sec. 2, Prohibition on use of, procurement of, and contracting related to certain foreign-made LiDAR technology: The Secretary of Transportation cannot buy or obtain any covered LiDAR technology, LiDAR from a covered LiDAR company, or LiDAR from a covered foreign country. The Secretary also cannot enter into, extend, or renew a contract with any entity unless that entity certifies that no such LiDAR will be used in the contract. The Secretary may waive this prohibition on a case-by-case basis by notifying Congress in writing at least 15 days in advance that the activity is in the national interest.

Sec. 2(c), Prohibition on use of loan or grant funds for certain LiDAR: When the Secretary provides loan or grant funds to an entity, the Secretary must ensure none of those funds are used to buy or use any covered LiDAR technology, LiDAR from a covered LiDAR company, or LiDAR from a covered foreign country.

Sec. 2(d), Applicability: This section applies to any spending or contracts made on or after June 30, 2026. It does not apply to applications for exemptions from Federal motor vehicle safety standards or motor carrier safety regulations, or to any grant, procurement, or contracting action for testing, research, evaluation, analysis, or training related to vehicle safety.
