Summary

This bill ensures the continued availability of specialized infant formula for preterm babies by giving federal courts jurisdiction over related civil claims. It amends federal law to allow these cases to be heard in federal district courts and permits defendants to remove such cases from state courts.

Sec. 3, Federal jurisdiction over certain infant formula actions: This section gives federal district courts the authority to hear civil cases involving alleged injuries from preterm infant formula regulated by the FDA, as long as the plaintiffs and defendants are from different states or one party is from a foreign country. It does not limit the power of the multidistrict litigation panel.

Sec. 4, Removal: This section allows any defendant to move a civil case about preterm infant formula from state court to federal court without needing all defendants to agree.

Sec. 5, Applicability: The bill applies to any civil case that is already pending or filed on or after the date the bill becomes law, regardless of when the case was started in state court.
