This bill requires large digital advertising platforms to report annually to the Federal Trade Commission on their public service advertisements, especially those related to mental and behavioral health. The FTC must then summarize these reports for Congress. The requirements end after 5 years.
Sec. 2, Digital advertising platforms public service advertising reporting: Within one year of enactment and each year after, a covered digital advertising platform must submit a report to the FTC. The report must include: the number and percentage of total ads that were public service ads; the estimated dollar value of those ads; how many focus on local or regional mental and behavioral health resources; how many promote free mental or behavioral health resources; and a description of how the ads meet the definition of a public service ad. The FTC must then, within 180 days and annually, submit a publicly available summary of these reports to the Senate Commerce Committee and the House Energy and Commerce Committee. The bill defines key terms: "Commission" means the FTC; "public service advertisement" means an ad served for free that promotes mental or behavioral health resources raising awareness of community events to address social isolation, or promoting local or regional mental health resources approved by SAMHSA that mitigate self-harm, suicide, eating disorders, substance abuse, behavioral addiction, or social isolation, and is relevant and accessible to targeted audiences; "covered digital advertising platform" means a social media platform, website, online service, app, or mobile app that derives revenue from advertising, primarily provides a community forum for user-generated content, and has over 100 million unique monthly users or visitors; "user" means an individual who registers an account or creates a profile on such platform. The bill does not override any privacy or data security laws. All requirements under this Act end 5 years after enactment.
