Summary

This bill amends the Infrastructure Investment and Jobs Act to classify certain yellow organic pigments as construction materials for purposes of the Build America, Buy America Act. It requires that these pigments be produced in the United States and directs the Office of Management and Budget to update guidance accordingly.

Sec. 2, Inclusion of certain materials in Build America, Buy America Act: This section adds a new subsection to the Infrastructure Investment and Jobs Act. It states that, starting immediately upon enactment, all yellow organic pigments used in water-based paints for road, highway, or airport surface markings are considered construction materials. Two years after enactment, all yellow organic pigments used in any formula for such markings are considered construction materials. For these pigments, "produced in the United States" means all manufacturing processes from initial combination of materials through the chemical reaction that synthesizes the pigment must occur in the United States. The Director of the Office of Management and Budget must update relevant guidance within 90 days of enactment to reflect this change.
