Summary

This bill amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to require the President to provide assistance for predisaster hazard mitigation measures and adjust the federal cost share for certain building resilient infrastructure and communities projects.

Sec. 2, Federal share adjustment: For small mitigation projects costing less than $1,000,000, the President must contribute at least 90% of the total cost. For mitigation activities involving a critical facility (such as an emergency operation center, healthcare facility, police or fire station, school, or power station) costing less than $1,000,000, the President may contribute more than 90% of the total cost.

Sec. 3, Mandatory mitigation: Changes the law so that the President is required (rather than allowed) to provide technical and financial assistance for predisaster hazard mitigation.

Sec. 4, National public infrastructure predisaster mitigation assistance: Changes the law so that the President must set aside for predisaster mitigation an amount that is not less than 3 percent and not more than a specified amount of certain disaster relief funds.

Sec. 5, Tribal provisions: Adds Indian Tribes alongside States and local governments as eligible entities for predisaster mitigation assistance. Indian Tribes can access assistance directly from the President, through a Governor or State recommendation, or through a Tribal set-aside of funds. Technical and financial assistance to Indian Tribes must be used for Direct Technical Assistance to improve resilience, build mitigation programs, develop applications, and carry out mitigation projects. Defines 'Indian Tribe' by reference to the Indian Self-Determination and Education Assistance Act.
