Summary

This bill requires Transmission Organizations to allow aggregators of retail customers to submit bids into organized wholesale electric markets that aggregate the demand flexibility of customers of certain large utilities, overriding any state law or commission prohibitions on who may bid. The Federal Energy Regulatory Commission must issue a rule to implement this within one year of enactment.

Sec. 2, Aggregator bidding into organized power markets: Despite any state law or state commission prohibition on who may bid into an organized wholesale electric market, each Transmission Organization must allow aggregators of retail customers to submit bids that aggregate demand flexibility of customers of utilities that distributed more than 4,000,000 megawatt-hours in the previous fiscal year, consistent with applicable market rules that do not establish such a prohibition. The Federal Energy Regulatory Commission must issue a rule to carry out this requirement within one year of enactment.
