Summary

This bill amends the Clean Air Act to prohibit the Environmental Protection Agency (EPA) from reallocating renewable fuel obligations that apply to small refineries with an extension of an exemption under the Renewable Fuel Standard. It also requires the EPA to include the gasoline or diesel refined by such small refineries when calculating the total volume of fuel produced or imported by a person for determining their renewable fuel obligations.

Sec. 2, Prohibition on reallocation of obligated volumes: This section adds a new paragraph to the Clean Air Act that prohibits the EPA Administrator from reallocating any renewable fuel obligation applicable to a small refinery that has an extension of an exemption to other persons when making determinations for each calendar year. Additionally, when determining a person's renewable fuel obligations for a calendar year, the Administrator must include the gasoline or diesel refined by a small refinery owned or operated by that person that has an extension of an exemption in the total volume of gasoline or diesel fuel produced or imported in that year.
