The CHAT Act requires operators of companion AI chatbots to implement age verification measures and establish protections for minor users. It defines a companion AI chatbot as a system primarily for simulating interpersonal or emotional interaction, and a minor as anyone under 18. Covered entities must create user accounts, verify ages using commercially available methods, and classify users as minors or adults. For minor accounts, entities must link them to a verified parental account, obtain parental consent, inform parents of any suicidal ideation interactions, and block access to chatbots engaging in sexually explicit communication. Age verification data must be kept confidential. Entities must monitor for suicidal ideation and provide the National Suicide Prevention Lifeline contact. A popup must notify users every 60 minutes that they are not talking to a human. The FTC must issue compliance guidance within 180 days. Violations are treated as unfair or deceptive acts under the FTC Act, enforceable by the FTC and state attorneys general. A safe harbor exists for entities that rely in good faith on user-provided age information, comply with FTC guidance, and follow widely accepted industry standards. The Act takes effect one year after enactment.
