This bill amends the Social Security Act to require pharmaceutical and device manufacturers to publicly disclose payments made to patient advocacy organizations. It expands the existing Open Payments program to include these organizations as recipients of covered payments.
Sec. 2, Disclosure of payments to patient advocacy organizations: Starting March 31, 2027, and every 90 days thereafter, applicable manufacturers and group purchasing organizations must submit to the Secretary details of any covered payment made to a patient advocacy organization, including the organization's name and payment amount. A covered payment includes direct or indirect transfers of value, where an indirect payment is one made through a third party at the manufacturer's direction. A patient advocacy organization is defined as a tax-exempt 501(c)(3) organization that provides education, advocacy, and support for patients and caregivers, focuses on a medical condition diagnosed by a licensed practitioner, or helps vulnerable individuals affected by medical conditions. The bill also updates existing law to include patient advocacy organizations alongside covered recipients in certain provisions. The Paperwork Reduction Act does not apply to this section.
