Summary

This bill amends the Clean Air Act to prohibit states from setting their own emission standards for existing locomotives and engines used in locomotives. It expands the existing federal preemption on state emission standards for nonroad engines and vehicles to cover all locomotives engaged in interstate commerce as common carriers.

Sec. 2, Prohibition on state standards for existing locomotives and engines: The bill modifies Section 209(e)(1) of the Clean Air Act to broaden the categories of nonroad engines and vehicles for which states cannot set emission standards. It adds a new category (C) that explicitly covers locomotives or engines used in locomotives that are not already covered by subparagraph (B) and that are engaged in commerce, defined as providing common carrier railroad transportation for compensation under federal law.
