This bill requires all aircraft, including military aircraft, operating in Class B airspace in the national airspace system to install and operate both ADS-B In and ADS-B Out equipment. It also repeals a previous exemption for certain Department of Defense aircraft from ADS-B equipment requirements.
Sec. 1, ADS-B In and ADS-B Out equipment required for aircraft operating in Class B airspace: Beginning on the date of enactment, no aircraft may operate in Class B airspace unless it has ADS-B In and ADS-B Out equipment meeting performance requirements specified by the FAA Administrator, and the equipment must be installed, activated, and receiving whenever the aircraft is taxiing or in flight. Neither the Secretary of Transportation nor the Administrator may implement any regulation that exempts aircraft, including military aircraft, from this requirement. The bill repeals Section 1046 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which had exempted certain Department of Defense aircraft from ADS-B equipment requirements. The bill defines key terms: "Administrator" means the FAA Administrator; "ADS-B In" means onboard avionics that receives ADS-B Out broadcasts of an aircraft's state vector and other required information; "ADS-B Out" has the meaning given in federal regulations; and "aircraft" includes fixed wing aircraft, rotorcraft, powered-lift aircraft, and any other form of manned aircraft.
