Summary

This bill directs the Consumer Product Safety Commission (CPSC) to create a safety standard for certain gates and to run a public education campaign about gate dangers. Sec. 2, Consumer product safety standard for covered gates: Within one year, the CPSC must issue a final safety standard for covered gates that includes meeting specific ASTM standards (F900-25, F1184-23e1, or F2200-24) and, if the gate has an operator, the ANSI/CAN/UL 325 standard. The CPSC will decide which types of gates are covered. If a voluntary standard is revised, the organization must notify the CPSC; the revision is automatically adopted after 180 days unless the CPSC objects within 90 days. The CPSC can later modify the standard through rulemaking. Any standard issued under this section is treated as a consumer product safety rule under the Consumer Product Safety Act. Sec. 3, Education and awareness campaign: Within two years, the CPSC must run a national campaign to educate the public about dangers of covered gates, including detached or falling gates, and low-cost prevention methods. The campaign must include educational materials for manufacturers, contractors, retailers, service companies, consumers, owners, operators, building officials, and local educational agencies. Within three years, the CPSC must report to Congress on the campaign. Sec. 4, Definitions: Defines key terms: 'building official' as state, tribal, territorial, or local officials involved in building codes; 'Commission' as the CPSC; 'covered gate' as automatic or manual vehicular gates, or any gate over 48 inches wide or 84 inches or more in height; 'local educational agency' as defined in the Elementary and Secondary Education Act; 'manufacturer' as defined in the Consumer Product Safety Act; 'positive stops' as immovable components that physically stop a gate's motion; and 'State' as defined in the Consumer Product Safety Act.
