Summary

This bill amends the Internal Revenue Code to treat certain marketplace providers as importers for the excise tax on sporting goods. It applies to sales during calendar quarters beginning more than 60 days after enactment and does not create any inference about other persons being treated as importers.

Sec. 2, Certain marketplace providers treated as importers for purposes of the excise tax on sporting goods: For a specified marketplace sale of a taxable sporting good article, the marketplace provider is treated as the importer and seller. A specified marketplace sale is one where the provider hosts listings and collects payments, the article is transported to the U.S. from outside in connection with a sale, and the manufacturer is not the provider. A marketplace provider is a person in the business of hosting listings and collecting gross receipts from the purchaser. Related persons are treated as one person. Taxable sporting good articles are those subject to tax under section 4161. The rule does not apply if the tax would otherwise be imposed on a person other than the purchaser. The Secretary may issue regulations to carry out this subsection.
