This bill authorizes the Department of Labor's voluntary protection program, renaming it the Michael Enzi Voluntary Protection Program. It establishes a program to recognize employers who voluntarily commit to comprehensive safety and health management systems, including hazard assessment, prevention, management participation, and employee training.
Sec. 2, Michael Enzi Voluntary Protection Program: The Secretary of Labor must establish a voluntary protection program to encourage and recognize excellence in protecting employees from occupational hazards. The program requires employers to submit applications, conduct annual self-evaluations, and undergo onsite evaluations by OSHA representatives, which will not result in enforcement citations but require correction of serious hazards within 90 days. Employers must share safety information with employees. Periodic reevaluations are required for continued participation. Oversight of worksite audits and evaluations must be under direct supervision of designated OSHA employees, conducted by special government employees. The Secretary must direct the Assistant Secretary to develop documentation policies for follow-up actions on fatalities and serious injuries, establish internal controls for consistent compliance, and create a system for monitoring program performance with specific goals and measures. Worksites in the program are exempt from programmed inspections. No payment is required for participation. Within two years, the Secretary must establish a written plan to modernize technology used to administer the program, including procurement of software for applications, self-evaluations, audit reporting, and other functions.
Sec. 2(c), Basic, No-Cost Tiered Safety and Health Management System Challenge Program: The Secretary must modernize and support a tiered challenge program within OSHA to serve as a safety and health management system evaluation tool for participating employers, with no payment required.
Sec. 2(d), Transition: The Secretary must ensure an orderly transition from the existing voluntary protection program to the new program, ensuring the new program is based on and consistent with the existing one, and allowing employers in good standing to continue participation.
Sec. 2(e), Regulations and Implementation: Within two years, the Secretary must issue final regulations and begin implementation of the program.
Sec. 2(f), Funding: The Secretary must use at least 5 percent of OSHA's appropriated funds each fiscal year to carry out this Act.
