Summary

This bill protects and expands nationwide access to assisted reproductive technology (ART), including in vitro fertilization (IVF), and intrauterine insemination (IUI). It establishes a federal right to receive these services, requires health plans to cover them, expands access for military members and veterans, and mandates coverage under Medicaid and Medicare.

Title I, Protect IVF: Establishes a statutory right for individuals to receive ART or IUI from a health care provider without state prohibitions or limitations that conflict with American Society for Reproductive Medicine guidelines. It also gives health care providers a right to provide these services. This title preempts any inconsistent state law, except for certain state laws on disputes over reproductive genetic material or laws that protect access consistent with the guidelines.

Title II, Veteran Families Health Services: Subtitle A requires the Secretary of Defense to provide ART, IUI, and counseling to uniformed service members and their spouses, partners, or gestational surrogates, without regard to sex, gender identity, sexual orientation, infertility diagnosis, or marital status. It also establishes fertility preservation procedures for active-duty members after injury or illness or before deployment or hazardous assignments. Subtitle B adds ART, IUI, and counseling to the definition of medical services for veterans and requires the Secretary of Veterans Affairs to furnish these services to covered veterans and their spouses, partners, gamete donors, or gestational surrogates. It also requires coordination of reproduction and fertility research for veterans.

Title III, Access to Assisted Reproductive Technology and Intrauterine Insemination: Requires group health plans and health insurance issuers offering group or individual coverage to provide coverage for ART and IUI. It also requires state Medicaid plans to provide medical assistance for ART and IUI, effective October 1, 2027, and adds Medicare coverage for ART and IUI with 100% payment and no deductible.

Title IV, Family Building FEHB Fairness: Amends the Federal Employees Health Benefits (FEHB) program to require that health benefits plans include ART and IUI benefits, effective one year after enactment.
