This bill amends the Social Security Act to require Medicare Advantage organizations to report certain information about agents and brokers who enroll individuals into their plans, and to make some of that information public.
Sec. 2, Requiring reporting on certain agent and broker information: Starting with plan years beginning on or after January 1, 2028, Medicare Advantage organizations must annually report to the Secretary of Health and Human Services for each enrolled individual whether they were enrolled by an agent, broker, or other third party, and if so, the amount and form of compensation paid for that enrollment. They must also report the total compensation paid to all such agents, brokers, and third parties for all enrollments, plus any other related information the Secretary requires. Beginning with plan years on or after January 1, 2030, the Secretary must add an indicator to the Chronic Condition Data Warehouse to show whether an individual was enrolled by an agent or broker, and must make the total compensation and other required information publicly available on the Centers for Medicare & Medicaid Services website.
