Summary

This bill amends federal law to require the Attorney General to investigate and enforce the existing ban on partial-birth abortion, mandates reporting of violations, and orders reports to Congress.

Sec. 2, Investigation into remains of 5 babies discovered in Washington, DC: The Attorney General must investigate whether the 2003 Partial-Birth Abortion Ban was violated regarding the remains of 5 babies found by D.C. police on March 30, 2022, and submit a report to Congress within 6 months of enactment detailing the investigation and any enforcement actions.

Sec. 3, Requirement to investigate violations of the partial-birth abortion ban: The bill adds a new subsection to the existing ban requiring the Attorney General to investigate and take appropriate enforcement action for alleged violations.

Sec. 4, Mandatory reporting of violations: Any health care practitioner or employee of a hospital, physician's office, or abortion clinic who knows of a violation must immediately report it to an appropriate state or federal law enforcement agency.

Sec. 5, Report on violations of the partial-birth abortion ban: By October 1 each year, the Attorney General must submit to the House and Senate Judiciary Committees and publish online a report listing steps taken to inform abortion providers of their compliance responsibilities, the number of alleged violations over the previous 10 years, investigation efforts, and enforcement actions.

Sec. 6, GAO report: Within 18 months of enactment, the Comptroller General must review enforcement actions for alleged violations from fiscal years 2004 through 2024 and submit a report to the Judiciary Committees, including recommendations for strengthening enforcement.

Sec. 7, Severability: If any part of this bill or its amendments is found unconstitutional, the rest remains in effect.
