Summary

This bill provides the Food and Drug Administration (FDA) with new authorities and resources for regulating human foods, including research, advisory committees, and information sharing. Sec. 2, Sense of Congress on funding food sector innovation projects: Congress expresses that an account should be established to fund FDA activities such as critical research grants, a center of excellence, a public-private partnership, and other projects for innovation in the human foods sector. Sec. 3, Advisory Committee on Human Foods: The Secretary of Health and Human Services must establish a permanent advisory committee to advise the FDA Commissioner on food science, nutrition, and food safety, composed of experts and representatives from consumer, producer, and health professional organizations. Sec. 4, Critical research grant program: The Secretary, through the FDA Commissioner and NIH Director, must award competitive grants to eligible nonprofit organizations for research in areas like food biotechnology, nutrition, infant and maternal nutrition, ultra-processed foods, infant formula safety, dietary supplements, and public understanding of risks and benefits. Sec. 5, HFP and CDER center of excellence: The FDA Commissioner must establish a center of excellence to improve nutrition science and its relation to medicine, coordinating between the Human Foods Program and the Center for Drug Evaluation and Research on topics like weight loss drugs, food allergy medications, nutrition and health, and produce prescription programs. Sec. 6, Paperwork Reduction Act exemption for FDA research: The Paperwork Reduction Act will not apply to voluntary collection of information during FDA research. Sec. 7, Recordkeeping requirements for processed food recipes: Processed food manufacturers (excluding farms and restaurants) must allow FDA access to records of recipes and contents, including labeled and nonlabeled ingredients and amounts, and must submit nonlabeled contents (like flavors and colors) to the FDA, which will publish a list of such articles and their contents. Sec. 8, Public-private partnership for information sharing and chemical limits in foods: The FDA Commissioner must partner with nongovernmental entities to share information on food packaging materials and recommend limits for chemicals in food and food-contact substances, and report to Congress on the partnership's work within 18 months and annually thereafter.
