This bill amends the Internal Revenue Code to designate copper as an applicable critical mineral for the advanced manufacturing production credit and to include ore extraction costs in that credit. Sec. 1, Inclusion of copper as applicable critical mineral: This section adds copper to the list of applicable critical minerals under Section 45X(c)(6)(AA) of the Internal Revenue Code, effective for minerals produced and sold after December 31, 2025. Sec. 2, Inclusion of ore extraction costs: This section allows taxpayers who extract ore that is later refined into an applicable critical mineral to treat their extraction costs as eligible costs for the advanced manufacturing production credit, provided they submit a certification from the refiner that the ore was refined into such a mineral and sold to an unrelated person. The extraction costs are only eligible if the ore was extracted in the United States, or if extracted outside the U.S., the ore type is not commercially extracted in the U.S. and not from a foreign country of concern. The Secretary must issue regulations to prevent double benefits. This applies to costs incurred after December 31, 2025.
