Summary

This bill codifies the Direct File program into law, requiring the Treasury Secretary to establish and operate a free, government-owned online tax preparation and filing system for individual income tax returns, and prohibits agreements that restrict the government's ability to provide such services. Sec. 2, Prohibition on agreements restricting government tax preparation and filing services: The Treasury Secretary cannot enter into any new agreement that restricts the government's right to provide tax preparation or filing services, requires the Secretary to stop providing such services, or conditions any agreement on not providing them. Any existing agreements that do so are voided 30 days after enactment. Sec. 3, Codification of Direct File: The Internal Revenue Code is amended to add a new section requiring the Secretary to establish and operate a free online tax preparation and filing program. The program must be government-owned, use IRS data to simplify filing, be user-tested and interview-based, use plain language in multiple languages, be accessible on mobile devices, comply with accessibility guidelines, be prominently displayed on the IRS website, and be promoted through mass marketing. It must provide integrated customer support, including live chat, and allow filing even if not required. By 2028, at least 50% of taxpayers in participating states must be eligible, with continued expansion. Participating states are those that integrate state tax filing or have no state income tax. The Secretary reports to Congress annually on usage and satisfaction. No fees can be charged. The Secretary must enable seamless state and local tax filing for participating states, including a grant program providing $1,000,000 to each qualifying state. The bill also adjusts filing deadlines for certain information returns and authorizes necessary appropriations for fiscal years 2026 through 2035, effective for tax years beginning after 2025.
