Summary

This bill amends the Public Health Service Act to require that Federally-qualified health centers (FQHCs) pay no more than the 340B ceiling price for covered outpatient drugs at the time of purchase, rather than through later rebates or reimbursements.

Sec. 2, Ensuring upfront 340B discounted pricing for Federally-qualified health centers: The bill adds a new paragraph to the 340B program requiring that the Secretary of Health and Human Services cannot enter into a drug pricing agreement with a manufacturer that would require an FQHC to pay more than the 340B ceiling price at the point of purchase. It clarifies that this does not allow any arrangement where the FQHC pays more upfront and later gets a rebate or other payment to reconcile the difference. The changes take effect on the date the bill is enacted and apply to drugs purchased on or after that date, and existing agreements must comply with these requirements from the enactment date.
