The REAL Act requires federal officials to disclose when they use generative artificial intelligence (AI) to create or manipulate content that they publish or release to the public. It sets rules for disclaimers, enforcement, audits, and penalties for non-compliance.
Sec. 2, Disclosure of content created or manipulated using generative AI: Federal officials cannot publish content made or altered with generative AI unless it includes a clear, plain-language disclaimer stating that fact, explaining how the content was generated or altered, and describing the technology used. Exceptions include internal communications, classified content (if a compliant summary is kept), minor edits that don't change meaning, routine text drafts reviewed by staff, and personal social media posts unrelated to official duties.
Implementation and enforcement: Within 180 days, the Office of Management and Budget must issue rules for compliance and guidelines for disclaimers. Annually, the President, Vice President, and agency heads must submit compliance audits to Congress and post them on public websites. If content is published in violation, it must be retracted and a corrective communication issued.
Penalties: For non-compliance, a corrective action plan must be submitted within 30 days. If not followed, the Comptroller General reviews and issues corrective actions. Federal officials may face disciplinary action, and contractors may face restrictions, contract termination, or other actions.
Definitions: "Agency" includes the Executive Office of the President. "Federal official" covers the President, Vice President, and agency officers/employees. "Generative artificial intelligence" means algorithmic systems that non-deterministically create or modify digital content like text, images, video, or sound.
Effective date: This section takes effect 90 days after enactment.
