The RESET Act prohibits certain online platforms from allowing minors under 16 to create or maintain accounts, requires termination of existing minor accounts within a set timeline, and mandates deletion of their personal data. It is enforced by the Federal Trade Commission and allows state attorneys general to bring civil actions, while preempting state laws on the same subject.
Sec. 2, Prohibition on accounts and profiles for minors: Covered platforms cannot let minors create or keep accounts. Within 60 days of enactment, platforms must identify minor accounts; within 180 days, notify users; and within 30 days after notice, terminate the account. Upon termination, platforms must immediately delete all personal data from the minor, but for 90 days after termination, must allow the user to request and receive a copy of their data in a readable, portable format within 45 days of the request.
Enforcement by Commission: Violations are treated as unfair or deceptive acts under the FTC Act, and the FTC enforces this section with its full powers, penalties, and privileges.
Actions by States: State attorneys general may sue in state or federal court to enjoin violations, enforce compliance, or obtain damages on behalf of residents. They must notify the FTC before filing, and the FTC can intervene. State actions are barred while a federal action is pending against the same defendant for the same violations.
Relationship to Other Laws: No state or local government may enforce any law related to this section, preempting state regulations.
Effective Date: This section takes effect one year after enactment.
Definitions: 'Commission' is the FTC; 'covered platform' is defined by the TAKE IT DOWN Act; 'know' means actual knowledge or willful disregard; 'minor' is under 16; 'personal data' is defined by COPPA; 'user' is an individual with an account or profile on a covered platform.
