This bill amends title 10 of the United States Code to improve access to certain medications under the TRICARE program for military beneficiaries and their families.
Sec. 2, Improvements relating to access, fairness, and transparency under TRICARE pharmacy benefits program: This section makes several changes. First, it extends the period during which eligible beneficiaries can choose how to get their prescription refills, and starting October 1, 2026, allows them to elect to receive non-generic maintenance medications through any available means, including retail pharmacies. Second, it sets new reimbursement standards for pharmacy benefit managers, requiring that TRICARE retail pharmacies be paid at least the actual acquisition cost or a proxy based on national average drug acquisition cost, plus a professional dispensing fee equal to the state's Medicaid fee. It also prohibits the contractor from imposing any fees on retail pharmacies, including point-of-sale, retroactive, or hidden fees. Third, it mandates that the Comptroller General conduct annual audits of reimbursement data, price concessions, and the adequacy of the retail pharmacy network, with results submitted to Congress. The Secretary of Defense must ensure contractors provide necessary information for these audits.
Sec. 2(c), Report: Within 90 days of enactment, the Secretary of Defense must submit a plan to Congress for implementing this section.
