Summary

This bill expands the Medicare drug price negotiation program to cover more drugs and include commercial health plans, requires consideration of international prices in negotiations, applies prescription drug inflation rebates to the commercial market, and establishes out-of-pocket limits for prescription drugs under private health insurance, including a specific cap for insulin. Title I, Drug Price Negotiation Program: Sec. 101 increases the number of drugs subject to negotiation from 20 to 50 and expands the program to include participants in group health plans and individual market insurance, allowing these plans to voluntarily participate or opt out. Sec. 102 requires the Secretary to consider the average international market price (from Australia, Canada, France, Germany, Japan, and the United Kingdom) when negotiating drug prices, effective for years beginning on or after January 1, 2028. Sec. 103 repeals changes made to the drug price negotiation program by Public Law 119-21, restoring the prior law. Title II, Prescription Drug Inflation Rebates: Sec. 201 applies prescription drug inflation rebates, currently for Medicare Part B and Part D drugs, to drugs furnished in the commercial market, using billing units and excluding units paid by Medicaid or subject to other rebates. Title III, Out-of-Pocket Limits for Prescription Drugs: Sec. 301 establishes an annual out-of-pocket limit on cost-sharing for prescription drugs under group health plans and individual market insurance, starting at $2,000 for self-only coverage in 2027 and adjusted annually, with an overall cost-sharing limit. Sec. 302 requires that for plan years beginning on or after January 1, 2027, group health plans and insurers must cover selected insulin products without a deductible and cap cost-sharing at the lesser of $35 per 30-day supply or 25% of the net negotiated price.
