The No Tricks on Treats Act of 2025 amends the Federal Food, Drug, and Cosmetic Act to require that food (other than dietary supplements) containing synthetic dyes, added artificial or natural flavoring, or nonnutritive sweeteners must prominently state this fact on the principal display panel of the packaging, or else the food is considered misbranded. Sec. 2, Inclusion of food containing dyes, flavoring, and sweeteners as misbranded: This section adds new paragraphs to section 403 of the Federal Food, Drug, and Cosmetic Act. It requires that if food (other than a dietary supplement) contains any synthetic dye (defined as a batch-certified dye under 21 C.F.R. Part 74) or any added artificial or natural flavoring, the packaging's principal display panel must prominently state that fact. Similarly, if such food contains any nonnutritive sweetener, that fact must also be prominently stated on the principal display panel. Failure to do so makes the food misbranded.
