Summary

This bill requires the immediate release of funds for the Supplemental Nutrition Assistance Program (SNAP) and the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) to ensure uninterrupted benefits, and includes provisions for continuous operation and reimbursement of states or tribes. Sec. 2, Appropriation: For fiscal year 2026 and each year after, if no interim or full-year appropriations for the Department of Agriculture are enacted, the Secretary of Agriculture is given the necessary funds to provide uninterrupted benefits under SNAP and WIC. Sec. 3, Requirement to release funds: The Secretary must immediately obligate and make available all funds appropriated by Congress for SNAP and WIC, and no executive branch officer may withhold or delay these funds. State agencies must continue to process applications, and eligible individuals must receive benefits within five days after funds are obligated. No enrollment freeze or waiting list is allowed due to funding delays. Sec. 4, Continuity of EBT card access and processing: The Secretary must ensure uninterrupted operation of Electronic Benefit Transfer (EBT) systems for SNAP and WIC, even during a lapse in appropriations. State agencies must load benefits onto EBT cards immediately upon receiving federal funds, and no agency may suspend or restrict EBT cards due to temporary funding delays. Sec. 5, Reimbursement of states or tribes: The Secretary must reimburse any state or federally recognized American Indian Tribe that uses its own funds to cover a lapse in federal funding for these programs, up to the amount expended.
