This bill amends the Richard B. Russell National School Lunch Act to require mandatory certification for certain students and reduce stigma associated with unpaid school meal fees.
Sec. 2, Unpaid meal debt: This section makes several changes. It changes the heading of a subsection from "Discretionary" to "Mandatory" and replaces "may" with "shall" to require local educational agencies to directly certify children for free meals. It also requires local educational agencies to revise previously submitted meal claims to reflect retroactive eligibility approval for free or reduced price meals from the start of the current school year. Additionally, it prohibits overt identification of children based on unpaid meal fee status, such as physical segregation, special tokens, or public announcements. It requires agencies to attempt direct certification or provide application materials to households with a week or more of unpaid fees. It restricts collection practices, including prohibiting communication about unpaid fees to the child (except via sealed letters), withholding educational opportunities, or using debt collectors. It also prohibits disposing of food already served to a covered child. The section defines "covered child" as a child enrolled in a participating school whose household owes unpaid meal fees or who is eligible for free or reduced price meals, and defines "unpaid school meal fees" as outstanding fees for lunches or breakfasts under the Act.
