Summary

This bill exempts certain telecommunications facility collocation projects from environmental and historical preservation reviews under the National Environmental Policy Act (NEPA) and the National Historic Preservation Act (NHPA).

Sec. 2, NEPA and NHPA exemptions for collocation of telecommunications service facilities: A federal authorization for a covered project cannot be considered a major federal action under NEPA, and a covered project cannot be considered an undertaking under NHPA. A covered project is defined as a project for placing, constructing, or modifying a telecommunications service facility in or on eligible support infrastructure that requires a permit, license, or approval from the Federal Communications Commission (FCC) or is otherwise subject to FCC jurisdiction. Eligible support infrastructure is infrastructure that supports or houses a wire communication facility at the time a complete request for authorization is received by a state, local government, or Indian Tribe. The bill defines key terms including Commission (FCC), Federal authorization (any required federal permit, license, or approval), Indian Tribe (as defined in the Federally Recognized Indian Tribe List Act of 1994), State (including territories and possessions), telecommunications service (as defined in the Communications Act of 1934), and telecommunications service facility (a facility designed to provide or facilitate interstate or intrastate telecommunications service, including those used for other services).
