Summary

This bill amends the Social Security Act to improve Medicare coverage for orthotic and prosthetic care, focusing on patient safety, reducing fraud, and ensuring access to appropriate devices. It prohibits payment for certain orthotics and prosthetics delivered via drop shipment, expands the types of practitioners exempt from competitive bidding, and clarifies coverage for replacement custom-fitted and custom-fabricated orthotics. The Secretary of Health and Human Services must issue final regulations within one year.

Sec. 2, Increasing protections for Medicare beneficiaries receiving orthotic and prosthetic care: This section has four parts. (a) Prohibits Medicare payment for orthotics and prosthetics (excluding supplies) that are drop-shipped directly to a patient who has not received training from a qualified practitioner on fitting, adjustment, care, and use. (b) Adds physical therapists, occupational therapists, orthotists, and prosthetists to the list of practitioners whose items are exempt from competitive acquisition programs, alongside physicians. (c) Expands the existing replacement coverage for prosthetic devices to also include replacement of custom-fitted orthotics and custom-fabricated orthotics. (d) Requires the Secretary of Health and Human Services to issue final regulations implementing these changes within one year of enactment.
