Summary

This bill amends the Internal Revenue Code of 1986 to exempt certain less-than-lethal projectile devices from federal firearms and ammunition taxes and from the National Firearms Act. It aims to modernize tax and regulatory treatment for these devices.

Sec. 2, Exemption from firearms and ammunition tax: This section creates a new tax exemption for less-than-lethal projectile devices, certain listed devices, and their ammunition. A less-than-lethal projectile device is defined as one not designed to fire common handgun, rifle, or shotgun ammunition, or projectiles over 500 feet per second; intended to avoid death or serious injury; and not able to accept certain ammunition feeding devices. Manufacturers, producers, or importers can request a classification determination from the Secretary, who must respond within 90 days. The Secretary must publish and annually update a list of qualifying devices, and also a separate list of devices that would qualify except for exceeding 500 feet per second, with an annual report to Congress on that second list. The exemption applies to sales after the bill's enactment, with special rules for determination requests received in the first 180 days.

Sec. 3, Exemption from National Firearms Act: This section amends the definition of "firearm" under the National Firearms Act to exclude less-than-lethal projectile devices (as defined in Sec. 2) and devices on the Secretary's list under Sec. 4182(d)(1)(B), alongside antique firearms.
