This bill requires group health plans that cover anticancer medications given by a healthcare provider to also cover oral anticancer drugs with no less favorable cost-sharing. It applies to plan years starting on or after January 1, 2026. Sec. 2, Parity in cost-sharing for oral anticancer drugs: A group health plan covering intravenously administered or injected anticancer medications must ensure that cost-sharing for FDA-approved, patient-administered oral anticancer drugs is no less favorable. This applies only if the treating physician finds the oral medication medically necessary or clinically appropriate. Plans cannot increase out-of-pocket costs, reclassify benefits to raise costs, or impose stricter limits on oral anticancer drugs than on injected ones. The section does not require replacing other anticancer drugs with oral ones, does not prohibit prior authorization, and does not override stronger state laws. Cost-sharing includes deductibles, coinsurance, copayments, and out-of-pocket maximums. Sec. 3, GAO study: Within two years of enactment, the Comptroller General must study the impact of the new parity requirement on out-of-pocket costs for oral anticancer drugs, comparing plans subject to the requirement with those not subject to it, and submit a report to Congress with recommendations to reduce financial barriers to access.
