Summary

This bill exempts certain communications facility projects in disaster areas from environmental and historical preservation reviews. It allows projects to replace or improve communications facilities after a major disaster or emergency declared by the President to skip requirements under the National Environmental Policy Act (NEPA) and the National Historic Preservation Act (NHPA).

Sec. 2, Application of NEPA and NHPA to covered communications projects: This section provides that a Federal authorization for a covered project cannot be considered a major Federal action under NEPA, and a covered project cannot be considered an undertaking under NHPA. A covered project is defined as one carried out within a disaster or emergency area declared by the President, completed within 5 years of that declaration, and that replaces a damaged communications facility or makes improvements necessary for recovery or future disaster mitigation. The term 'communications facility' is defined by reference to existing law, and 'Federal authorization' includes any required permits, certifications, or approvals under Federal law.
