This bill amends the Infrastructure Investment and Jobs Act to add certain yellow organic pigments to the list of construction materials covered by the Build America, Buy America Act. Sec. 2, Amendment to Build America, Buy America Act: The bill changes the definition of construction materials to include all yellow organic pigments where all manufacturing processes from initial combination of materials through the chemical reaction resulting in the synthesized pigment occurred in the United States. The chemical reaction must break intramolecular bonds and form new ones, or alter the spatial arrangement of atoms. This applies to pigments used in water-based paints for road, highway, or airport surface markings starting on the date of enactment, and to all formulas containing such pigments starting 2 years after enactment. Sec. 3, Implementation: Within 90 days of enactment, the Director of the Office of Management and Budget must update relevant guidance, including from the Made in America Office, to reflect this amendment.
