Summary

This bill, the ETHIC Act, aims to address patent thickets by limiting the number of patents that can be asserted in certain infringement actions. Sec. 2, Addressing patent thickets: This section amends patent law to limit a person bringing a patent infringement action against a drug or biological product applicant or maker to asserting no more than one patent per Patent Group. A Patent Group is defined as two or more commonly owned patents or applications that are linked through disclaimers under patent law. The person also cannot bring additional actions asserting a patent in the same Patent Group against that party. The amendment applies to applications submitted on or after the date the bill is enacted.
