Summary

This bill amends the Public Health Service Act to require group health plans and health insurance issuers offering group or individual coverage to cover diagnostic and supplemental breast examinations without any cost-sharing requirements, such as deductibles, coinsurance, or copayments. It also applies these requirements to grandfathered health plans and provides a safe harbor for high deductible health plans with health savings accounts.

Sec. 2, Requiring diagnostic and supplemental breast examinations to be covered with no cost-sharing: This section adds a new section 2730 to the Public Health Service Act, which prohibits group health plans and health insurance issuers from imposing cost-sharing requirements for diagnostic and supplemental breast examinations. It defines 'cost-sharing requirements' as deductibles, coinsurance, copayments, and similar out-of-pocket expenses. 'Diagnostic breast examination' is defined as a medically necessary examination used to evaluate an abnormality from a screening or other means, including diagnostic mammography, breast MRI, or breast ultrasound. 'Supplemental breast examination' is defined as a medically necessary screening for breast cancer when no abnormality is seen, based on personal or family medical history or other risk factors. The section also allows plans to require prior authorization or other utilization controls and does not supersede state laws with greater protections.

Application to grandfathered health plans: The bill amends the Patient Protection and Affordable Care Act to apply the new requirements to grandfathered health plans.

Application to high deductible health plans with health savings account eligibility: The bill amends the Internal Revenue Code to provide a safe harbor for high deductible health plans, allowing them to cover diagnostic and supplemental breast examinations without a deductible for plan years beginning on or after January 1, 2026, without losing their status as high deductible health plans.

Effective date: The amendments apply to plan years beginning on or after January 1, 2026.
