This bill amends federal law to prohibit the destruction of broadband internet access service by expanding existing protections for communication facilities. It updates Section 1362 of Title 18, United States Code, to include facilities used to provide broadband internet access service, extends coverage to any person or entity (not just those operated or controlled by the United States), removes the previous limitation to military or civil defense functions, and adds a definition for broadband internet access service. Sec. 2, Prohibiting destruction of broadband internet access service: The bill amends Section 1362 of Title 18 by inserting "including facilities used to provide broadband internet access service" after "means of communication"; inserting "or by any other person or entity" after "operated or controlled by the United States"; striking "used or intended to be used for the military or civil defense functions of the United States"; and adding a definition that broadband internet access service means a mass-market retail service by wire or radio providing capability to transmit data to and from all or substantially all internet endpoints, excluding dial-up, and includes any service the Federal Communications Commission finds to be a functional equivalent.
