Summary

This bill prohibits the sale of food containing unsafe poppy seeds by requiring the Secretary of Health and Human Services to set contamination limits for morphine, codeine, and other compounds, after which poppy seeds exceeding those limits are considered adulterated and banned from interstate commerce.

Sec. 3, Unsafe poppy seeds as adulterants in food: The Secretary of Health and Human Services must issue a proposed rule within one year of enactment, and finalize it within two years, establishing contamination levels for morphine, codeine, other alkaloid compounds, and any other designated compounds. Poppy seeds exceeding these levels are deemed adulterated under the Federal Food, Drug, and Cosmetic Act.

Sec. 4, Poppy seeds as a controlled substance: Nothing in this Act exempts contaminated poppy seeds from regulation under the Controlled Substances Act.
