Summary

This bill amends the Individuals with Disabilities Education Act to provide mandatory funding for part B, increasing federal contributions over time. Sec. 2, Mandatory funding of the Individuals with Disabilities Education Act: This section replaces the existing funding provision with a new schedule of authorized and appropriated amounts for fiscal years 2026 through 2035 and beyond. For each year, the funding is the greater of a specified dollar amount or a percentage of a calculated amount based on the number of children with disabilities aged 3 through 21 and the national average per-pupil expenditure. The amounts and percentages increase each year, starting at $16,661,928,000 or 11.6 percent for 2026 and reaching $69,644,540,000 or 40.0 percent for 2035 and each subsequent year. Funds become available on July 1 of each fiscal year and remain available through September 30 of the following fiscal year. Sec. 3, Offsets: The amounts appropriated under the amended section must be spent consistent with cut-as-you-go requirements.
