This bill amends the Internal Revenue Code to allow publicly traded partnerships (PTPs) to include income from a broader range of energy activities, such as power generation and fuel transportation, without losing their tax-advantaged status. It aims to expand the types of energy projects that can use this ownership structure.
Sec. 2, Green energy publicly traded partnerships: The bill updates the definition of qualifying income for publicly traded partnerships to include income from generating electric power or thermal energy using qualified energy resources (like wind, solar, or biomass), operating certain energy property, processing open-loop biomass or municipal solid waste at specific facilities, storing electric power or thermal energy using energy storage technology, operating combined heat and power systems, transporting or storing certain fuels (including those from renewable sources or hydrogen), converting renewable biomass into renewable fuel, producing fuel from captured carbon oxides that reduces lifecycle greenhouse gas emissions by at least 60%, generating power from qualifying gasification projects, capturing or generating power at carbon capture facilities, generating power from advanced nuclear facilities, and producing, storing, or transporting renewable chemicals with at least 95% biobased content that are not used for food, feed, fuel, or pharmaceuticals. These changes apply to taxable years beginning after December 31, 2025.
