This bill amends the Federal Food, Drug, and Cosmetic Act to exempt premium cigars from being regulated as tobacco products under that Act. Section 1, Findings: Congress lists findings from a 2022 National Academies report, stating that premium cigars are used by about 1% of U.S. adults, are less common among youth, and pose less physical risk than other tobacco products. Section 2, Exemption of premium cigars from certain tobacco regulation: The bill adds a new paragraph to the definition of 'tobacco product' in the Act, specifying that the term does not include a premium cigar. A premium cigar is defined as a cigar that is wrapped in whole tobacco leaf, has a 100% leaf tobacco binder, contains at least 50% long filler tobacco by weight, is handmade or hand-rolled with no machinery except simple tools, has no filter or nontobacco tip, has no characterizing flavor other than tobacco, contains only tobacco, water, and vegetable gum, and weighs more than 6 pounds per 1,000 units.
