This bill eliminates certain legal claims and enforcement actions under federal and state law related to the collection, processing, or disclosure of information or communications for a commercial purpose, specifically those involving pen registers, wiretapping, trap and trace, or eavesdropping, including California's Invasion of Privacy Act. It also bars any such claims or actions that were already in progress as of the bill's enactment date.
Sec. 2, Applicability of certain laws to collection, processing, or disclosure of information or communications for a commercial purpose: The bill states that no claim or enforcement action under federal or state law regarding pen registers, wiretapping, trap and trace, or eavesdropping (including California's Invasion of Privacy Act) can arise from the collection, processing, or disclosure of information or communications for a commercial purpose. Any such claim or action already in progress on the date of enactment cannot be maintained, adjudicated, or arbitrated after that date. The term "commercial purpose" includes using digital commerce for business operations, marketing, advertising, consumer input, facilitating sales or purchases, or any commercial or business purpose defined by state law where the activity occurs. "Digital commerce" means promoting, selling, purchasing, delivering, or supporting products or services through connected digital networks and tools, including cookies, pixels, session replay, chatbots, tags, and analytics.
