Summary

This bill amends the Nuclear Waste Policy Act of 1982 to change how the Secretary of Energy prioritizes acceptance of high-level radioactive waste or spent nuclear fuel from civilian nuclear power reactors for disposal or storage. It adds a new paragraph to Section 302(a) of that Act.

Sec. 2, Acceptance priority for high-level radioactive waste and spent nuclear fuel: The Secretary must prioritize waste or fuel from civilian reactors based on four factors: the reactor's operating status, the population of the area where it is located, the earthquake hazard of that area, and national security risk from continued storage there. Highest priority goes to a reactor that is decommissioned or decommissioning, located in the most populous area, located in the area with the highest earthquake hazard according to U.S. Geological Survey seismic hazard maps, and located in an area where continued storage poses a significant national security concern (as determined by the Secretary in consultation with the Secretaries of Defense and Homeland Security).
