This bill amends the Defense Production Act of 1950 to add the Secretary of Agriculture to the Committee on Foreign Investment in the United States (CFIUS) for certain agricultural transactions and to require CFIUS to consider certain agricultural land transactions involving foreign persons from specified countries.
Sec. 2, Inclusion of Secretary of Agriculture on CFIUS and consideration of certain agricultural land transactions: The Secretary of Agriculture becomes a CFIUS member for covered transactions involving agricultural land, agricultural biotechnology, or the agriculture industry (including transportation, storage, and processing). CFIUS must, after notification from the Secretary of Agriculture of a reportable agricultural land transaction, determine if it is a covered transaction and, if so, whether to initiate a review or take other action. These requirements end when a covered country (People's Republic of China, Democratic People's Republic of Korea, Russian Federation, or Islamic Republic of Iran) is removed from the list of foreign adversaries. A reportable agricultural land transaction is one the Secretary believes is a covered transaction, involves acquisition of agricultural land by a foreign person from a covered country, and requires a report under the Agricultural Foreign Investment Disclosure Act of 1978.
