Summary

This bill restricts the release of aliens from detention, mandates GPS monitoring and curfews for those on the nondetained docket, and requires removal for failing to comply with release conditions. Sec. 2, Limitation on participation in Alternatives to Detention: No alien may be released under the Alternatives to Detention program unless all available detention beds are filled, no other detention options exist, and the Secretary of Homeland Security has exhausted all reasonable efforts to detain them. Sec. 3, GPS tracking and curfew requirements for certain aliens: Every alien on ICE's nondetained docket must be enrolled in the Alternatives to Detention program, continuously monitored by GPS throughout immigration proceedings and until removal if ordered, and must stay at their designated home address from 10:00 p.m. to 5:00 a.m. Sec. 4, Removal of aliens who fail to comply with release order: The Immigration and Nationality Act is amended to require that if an immigration officer submits an affidavit stating an alien failed to comply with a release condition, the alien shall be ordered removed in absentia. Sec. 5, Severability: If any provision of this Act is found unconstitutional, the rest of the Act remains in effect.
