This bill amends the Social Security Act to establish new requirements for how Medicare Advantage plans use prior authorization. It mandates electronic prior authorization, transparency reporting, and enrollee protection standards, and gives the Secretary authority to set response timeframes.
Sec. 2, Prior authorization requirements: Medicare Advantage plans that use prior authorization must, starting in 2027, have an electronic program for secure transmission of requests and responses, excluding faxes, proprietary portals, or electronic forms that don't meet standards. Starting in 2026, plans must annually report to the Secretary a list of items and services subject to prior authorization, approval and denial rates, appeal data, use of decision-support or AI technology, average and median response times, and other information. Plans must also provide criteria and documentation requirements to providers and enrollees. The Secretary will publish this data on a public CMS website. The Medicare Payment Advisory Commission must report to Congress within 3 years of first data submission. Enrollee protection standards require transparent programs developed with enrollees and providers, allowing waiver of prior authorization based on provider performance, and annual reviews of prior authorization items. The term 'applicable item or service' means any benefit under the plan except Part D drugs. The GAO must report by 2032 on implementation, and HHS must report by 2027 defining 'real-time decision' and detailing a process for real-time decisions for routinely approved services.
Sec. 2(b), Secretary authority for timely responses: The Secretary may establish timeframes, such as 24 hours, for responses to prior authorization requests, including expedited requests, real-time decisions for routinely approved items, and any other request.
