This bill delays the inclusion of certain oral-only drugs for end-stage renal disease (ESRD) in Medicare's bundled payment system until January 1, 2027, and requires a study on related patient coverage, costs, and health outcomes. Sec. 2, Prohibition of implementation of oral-only policy for certain drugs under Medicare ESRD prospective payment system: The bill amends the American Taxpayer Relief Act of 2012 to extend the delay on implementing a policy that would include oral-only ESRD-related drugs in the Medicare ESRD prospective payment system. Specifically, it prohibits implementation of this policy for drugs indicated for reducing, managing, or controlling serum phosphate in individuals before January 1, 2027. The bill also requires the Secretary of Health and Human Services to submit a report to Congress and publish it on the CMS website within one year of enactment. This report must include data from 2022 through 2024 on: the number of ESRD patients enrolled in Medicare Part D or MA-PD plans and any coverage gaps; Part D expenditures on oral-only ESRD drugs and patient cost-sharing; patient adherence to prescriptions for such drugs, measured by serum phosphate levels; adverse events related to hyperphosphatemia and their estimated costs; and recommended strategies to improve adherence to phosphate binders or lowering agents and reduce costs to patients and the program.
