Summary

This bill limits the number of patents that can be asserted in certain patent infringement lawsuits related to drug and biological product applications. It amends patent law to restrict a plaintiff to asserting no more than one patent per Patent Group against certain defendants, including those who submit or hold applications for generic drugs or biosimilars, or who make, use, or sell such products. A Patent Group is defined as two or more commonly owned patents or applications that are linked by disclaimers to avoid obviousness-type double patenting. The change applies to applications submitted on or after the bill's enactment date.
