Summary

The AI Labeling Act of 2023 requires disclosures for AI-generated content to inform consumers. It mandates that generative AI systems include clear and permanent labels on images, videos, audio, multimedia, and text content, and establishes a working group to develop detection standards.

Sec. 2, Disclosures for AI-generated content: This section requires that any generative AI system producing image, video, audio, or multimedia content include a clear and conspicuous disclosure identifying it as AI-generated, with metadata including the tool used and creation date. For text content, including from chatbots, a similar disclosure is required. Developers and third-party licensees must implement procedures to prevent removal of these disclosures, such as contracts and access termination. Violations are treated as unfair or deceptive acts under the Federal Trade Commission Act, enforced by the FTC.

Sec. 2, AI-Generated Content Consumer Transparency Working Group: Within 90 days of enactment, the Director of NIST must form a working group with federal agencies, AI developers, private sector groups, social media platforms, and academics. Within one year, the group must publish a framework with technical standards for detecting AI-generated images, video, audio, and multimedia, guidelines for platforms, and recommendations for detecting text content. The Director must report to Congress on the framework and any legislative recommendations. The working group is exempt from the Federal Advisory Committee Act.

Sec. 2, Definitions: Key terms are defined, including 'AI-generated content' as content substantially created or modified by a generative AI system that materially alters its meaning. 'Clear and conspicuous' disclosure must be noticeable, understandable, and not avoidable, with specific criteria for visual and audible content. 'Generative artificial intelligence system' is defined as any system using AI to generate or modify content.
