Summary

This bill requires the National Instant Criminal Background Check System (NICS) to retain certain records and search additional databases when conducting firearm background checks. Sec. 2, Search of National Data Exchange: This section amends the Brady Handgun Violence Prevention Act to require NICS to retain records related to a firearm transfer or potential transfer for as long as needed to determine if the person is prohibited from receiving a firearm. If no determination is made within 30 days, NICS must notify the person in writing that records may be retained and that they can submit information to correct or clarify their records. It also requires NICS to search specific databases, including the National Data Exchange, the Interstate Identification Index System, the National Crime Information Center databases, the NICS Index, and any other database the Attorney General deems relevant, when determining if a person is prohibited from receiving a firearm.
